Doc’s adult entertainment trial begins

An attorney representing a Milford sports bar yesterday asked Building Commissioner Anthony DeLuca if he was rushed into approving plans for a school at 350 East Main St. in 2008, thereby hindering the bars plans to obtain an adult-entertainment license.

In the first day of a trial at Worcester Superior Court to determine if Docs Sports Bar was wrongfully denied a license to allow for burlesque dancers and Chippendales-type performers at 304 East Main St. in Milford, Docs attorney Kenneth Tatarian said DeLuca approved the school plans the same day he saw the application. The school being built was The Learning Experience, a private school for developmentally disabled students.

Did you receive a request from anyone to hurry along the issuance of the permit? Tatarian asked.

DeLuca said he did not.

In March 2008, the Zoning Board of Appeals denied Docs application for adult entertainment, arguing it violated a town bylaw that prohibits such businesses within 400 feet of a residential zone, homes, schools or places of worship.

In its decision, the board said the proposed club would be too close to neighboring Sacred Heart Cemetery, which was in a residential zone, as well as near sites in the works for a school/day care center for the mentally challenged and a temple.

Docs filed an appeal against board members a month later, asking the court to annul to boards decision.

DeLuca said yesterday he got Town Counsel Gerald Moodys blessing before he approved partial plans for the school Feb. 27, 2008, with the condition he see the full plans before building started.

He said its something hes done before and has had success with.

Its done on an honor system. … Ive never had a problem with it, DeLuca said.

Moody said the Planning Board approved the school site plan in July 2007.

Tatarian said that site where the school was planned had originally been approved for retail.

I consult with (Town Planner) Larry Dunkin and (Town Engineer) Michael Santora, DeLuca said. There was never an issue with the approved site plan.

Moody said he expects the testimony to end today.

Alaska Airlines raises price of in-flight entertainment

Alaska Airlines said it will begin charging more money to rent one of its in-flight entertainment systems.

The airline, a unit of Seattle-based Alaska Air Group Inc. (NYSE: ALK) said it will now cost $14 to rent a digEplayer on flights longer than 4.5 hours, up from $12. For flights less than 4.5 hours, digEplayers will cost $8, up from $6.

If customers reserve one of the in-flight entertainment systems online before the flight, they get a $2 discount on the rental.

Alaska Airlines officials said they’ve upgraded the fleet’s digEplayers, such as making the device smaller, lighter and with longer battery life.

“The new digEplayer is smaller and lighter than a laptop … and provides exciting and unique content for our travelers,” said Joe Sprague, Alaska Airlines vice president of marketing, in a statement.

Alaska Airlines has been offering digEplayers to passengers for the past eight years.

Alaska Airlines and its sister airline Horizon Air fly about half the traffic at Seattle-Tacoma International Airport.

Zoo Entertainment delays earnings report

Video game developer Zoo Entertainment Inc. said Thursday it will delay its fiscal 2010 earnings release and conference call due to an incomplete audit.

Zoo Entertainment (Nasdaq: ZOOG) had planned to announce results shortly before its conference call scheduled for 4:30 pm Thursday.

But it announced earlier in the day that its accounting firm is still finalizing its year-end audit.

The company had previously filed a notice with the Securities and Exchange Commission April 1 requesting a 15-day extension to file its annual report on Form 10-K. It said in that filing it had been unable to finish determining its level of impairment of intangible assets. It had previously incurred a $14.7 million impairment of goodwill in September 2009 related to an equity infusion in the company.

The Norwood-based company said it will reschedule the conference call for a later date and announce earnings shortly before that call.

Zoo Entertainment’s stock plunged 6 percent, or 29 cents, to $4.64 in mid-afternoon trading.

Made-for-TV-movie producer RHI Entertainment emerging from Chapter 11 proceedings

Scratch the closing credits for one well-known television production company.

RHI Entertainment Inc. announced Tuesday that its pre-packaged reorganization plan — which was designed to reduce the companys debt by more than $400 million — had won the approval of a bankruptcy judge in New York. RHI also said the company soon would be emerging from the Chapter 11 proceedings it initiated in December.

RHI is working with its key constituencies and exit lenders to complete the restructuring and
make the reorganization plan effective as quickly as possible, the company said in its statement.

The television movie company, which has offices in New York and Los Angeles, entered Bankruptcy Court with more than $600 million in debt.

As part of its reorganization, RHI plans to emerge with a new capital structure that includes a debt reduction of approximately $298 million as well as lower interest costs and extended debt maturities. The plan also includes settlement agreements with certain production partners and talent guilds, which eliminated or reduced payment terms associated with more than $100 million in obligations, the company said.

Remaining unsecured creditor claims would be paid in full, RHI said.

During the nearly four-month period the companywasin Bankruptcy Court, it continued to operate and began production of three TV miniseries, “Neverland,” “Treasure Island” and “Blackout.” It also produced movies for the Syfy and Hallmark channels.

This is a great day for RHI Entertainment,” Chief Executive Robert Halmi Jr. said in the statement. “With the Bankruptcy Court’s approval, we are cleared to emerge from Chapter 11 with a strengthened balance sheet and the financial flexibility that will enable us to continue to deliver high quality, one-of-a-kind entertainment content. Matthew Knowles Will No Longer Manage Beyonce’s Career

Beyonce Knowles exploded onto the music scene back in the mid-1990s, and her father, Matthew Knowles, has been there from Destiny’s Child to her solo career.

Beyonce announced Tuesday that her father will no longer be her manager and added that the business split is amicable. Beyonce, who is signed by Sony Music Entertainment, is working on releasing another album later this year, and she will now be looking to hire a new manager.

Matthew tells People that his focus is on another label, Music World Entertainment, where he’s helped lead many gospel singers to success, including Trinity 5:7, Brian Courtney Wilson, and Micha Stampley.

He explains to Us Magazine, “We mutually agreed to part ways in terms of me managing Beyonce, as my focus is in the investment of Music World Entertainments growing gospel and inspirational music division.”

Beyonce agrees with the decision, as she responds, “Ive only parted ways with my father on a business level… He is my father for life and I love my dad dearly. I am grateful for everything he has taught me.
